Edward Alder is an Asia-based full time barrister and arbitrator specialising in maritime and international trade work.
Edward Alder is regularly instructed in international arbitrations as counsel and arbitrator. His related Hong Kong High Court practice involves commercial trials, injunctions, asset freezing and arbitration-related applications, jurisdictional disputes and ship arrests. He is also instructed in international insolvency and shareholder / directorship disputes, in the maritime and financial services sectors.
Prior to joining the Bar in 2006, he was from 1997 to 2000 a partner of shipping law firm Holman Fenwick Willan Hong Kong and from 2000 to 2006 a partner of commercial law firm Bird & Bird Hong Kong. The first five years of his career were at Allens Linklaters in Sydney, Australia.
Edward Alder has conducted many international commercial arbitrations as counsel or arbitrator involving: international sale of goods (steel, scrap metals, iron ore, concrete pipes, oil, coal, coke, chemicals, timber, nickel ore), charterparties, ship management, mining (technical), mining (finance), shipbuilding (technical), shipbuilding (finance), insurance, shipboard cranes, China M&A, CO2 emissions trading, telecommunications and sports investment.
Edward is a Fellow of the HKIArb and the CIArb, an LMAA Supporting Member, an SCMA Panel Arbitrator, an HKIAC Panel Arbitrator and a HKMAG List Arbitrator. He is the Secretary of the Hong Kong Maritime Law Association. He is an annual Lecturer on the Hong Kong Bar Association Arbitration Course at Peking University. He is the author of the 100,000-word commentary to O.11 (service out of the jurisdiction) in Hong Kong Civil Procedure 2019. He also authored a 200-page chapter on IT law, Chitty on Contracts, Hong Kong Specific Contracts.
In addition to many shipping cases, Edward has conducted several leading Hong Kong High Court / Court of Appeal cases on arbitration including: The Alas [2014] 4 HKLRD 160, [2015] 1 Lloyd’s Rep 211 and [2015] 6 HKC 557 (CA) (establishes Hong Kong law on Admiralty jurisdiction following arbitral award), Chimbusco International Petroleum (Singapore) Pte Ltd v Fully Best Trading Ltd [2016] 1 HKLRD 582 (establishes Hong Kong law on indemnity costs on stay to arbitration), Dana Shipping & Trading SA v Sino Channel Asia Ltd [2017] 1 HKC 281 (enforcement of LMAA award, condition as to security) and [2016] 4 HKLRD 345 (effect of setting aside in court of seat), Dana Shipping & Trading SA v Sino Channel Asia Ltd [2017] 1 HKC 329 (CA) (no security for costs in enforcement appeals), Noor Maritime Ltd v Calandra Shipping Co Ltd [2018] 2 HKLRD 328 (Arbitration Ordinance s.20(6) power confined to stays of in rem Admiralty proceedings) and Parakou Shipping Pte Ltd v Jinhui Shipping & Transportation Ltd [2010] HKCA 330 (res judicata from arbitral award in Court, adjustment of security).
