Timothy Elsworth
Independent Arbitrator
Timothy Elsworth is an independent full-time maritime arbitrator with over 30 years experience as an international commercial and shipping lawyer including 15 years based in Hong Kong, Shanghai and Singapore.

Timothy Elsworth established his full-time practice as a maritime arbitrator and mediator upon returning from Singapore to London in 2012.  He is regularly appointed as sole or panel arbitrator in ad hoc and institutional arbitrations in a wide range of maritime disputes concerning charterparties (including Asbatankvoy, Australian Wheat, Barecon, Bargehire, Exxonvoy, Gencon, NYPE, Orevoy, Shelltime, Shellvoy, Supplytime, Vegoilvoy, Welsh Coal, etc.), demurrage and freight, exclusive shipment contracts, salvage and total loss, safe ports, stevedore damage, ship performance and maintenance, ship management, shipbuilding and repair, etc.  Given his background when in practice as a solicitor, his appointments frequently involve technical and operational issues of vessels.

Timothy is a Fellow of each of the Charterered, Singapore and Hong Kong Institutes of Arbitrators and is a Member of the London Maritime Arbitrators Association (an Aspiring Full Member).  He is a CEDR Accreditated Mediator.  His Singapore appointments have included ones under the SCMA Small Claims Procedure.  The majority of his ad hoc London appointments are made on LMAA Terms, again including the LMAA Small Claims Procedure.

Previously an international commercial and shipping lawyer Timothy’s practice always involved Asia.  He was a solicitor with:-

Sinclair Roche & Temperley, London 1984-1988
Sinclair Roche & Temperley, Hong Kong and Shanghai 1988-1999 (partner from 1993)
Ebsworth & Ebsworth, Sydney 1999-2007 (partner)
Stephenson Harwood, Singapore 2008-2012 (partner)

As a partner/solicitor Timothy dealt with most aspects of maritime law and marine insurance including “wet” maritime casualty claims (collision, salvage, seaworthiness, total loss, wreck removal, pollution, etc.) and “dry” cases (carriage of goods, charterparty and bill of lading claims, ship building disputes, etc.). He gained extensive experience as counsel in international court, arbitration and mediation proceedings.  Being a former mariner, he handled many high profile shipping casualties.  His practice also included considerable non-contentious work (drafting charterparties and insurance terms and conditions, ship finance documentation, etc.).
